Terms of Use

License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the app on Apple devices that you own or control, in accordance with the Apple App Store Terms of Service and these Terms. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the app except as permitted by law.

Auto-renewable subscription

Hit The Pose is offered as an auto-renewable subscription with a free trial. The terms are:

• Free trial: a 3-day free trial with full access. If you do not cancel before the trial ends, the subscription begins and the first payment is charged.
• Price: €4.99 per month or €29.99 per year (prices may vary by region and applicable taxes; the exact price is shown in the app before you confirm).
• Billing: payment is charged to your Apple ID account upon confirmation of purchase, or at the end of the free trial.
• Auto-renewal: the subscription automatically renews at the same price for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• Restore: you can restore an active subscription on a new device or after reinstalling by using the in-app “Restore Purchases” option.

Managing, cancelling & refunds

You can manage or cancel your subscription at any time in your App Store account settings: on iPhone, open Settings → [your name] → Subscriptions, select Hit The Pose, and choose to cancel. Cancellation takes effect at the end of the current billing period; you keep access until then. Turning off auto-renewal at least 24 hours before the period ends prevents the next charge.

Refunds are handled by Apple in accordance with the App Store's policies. We do not process payments and cannot issue refunds directly; please submit refund requests to Apple at reportaproblem.apple.com.

Acceptable use

You agree to use the app lawfully and responsibly. You will not:

• use the app to create, capture, or distribute content that is unlawful, harassing, or infringes others' rights;
• photograph people without the consent required by the law where you are;
• interfere with, disrupt, or attempt to gain unauthorised access to the app or its systems;
• use the app in any way that violates the App Store Terms of Service or applicable law.

Your content

Photos you take with the app are yours. The app saves a photo only when you choose to keep it, and image processing happens on your device as described in our Privacy Policy. You are responsible for how you use and share the photos you create.

Disclaimer of warranties

The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that pose suggestions will suit every scene or produce any particular result.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, photos, profits, or goodwill, arising out of or related to your use of the app. To the extent any liability cannot be excluded, it is limited to the amount you paid for the app in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable mandatory law, including your statutory consumer rights.

Governing law

These Terms are governed by the laws of Spain, without regard to conflict-of-law rules, and subject to any mandatory consumer-protection rights you have in your country of residence. Where required, disputes will be handled by the competent courts of Spain.
